1. Acceptance of These Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Kartenpae ("Kartenpae", "we", "us", or "our") governing your access to and use of the Kartenpae mobile application, related websites, and our LINE Official Account (collectively, the "Services"). By creating an account, accessing, or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Services.

2. Definitions

"Account" means the user account you register to access the Services.
"Content" means any data, text, images, voice, or other materials you submit to the Services.
"AI Features" means functionality that uses artificial intelligence to analyze your Content and generate categorizations, summaries, or insights.

3. Eligibility

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

4. Account Registration and Security

To use most features, you must create an Account using a valid email address or a supported third-party sign-in provider. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your Account. You agree to notify us immediately of any unauthorized use of your Account. We are not liable for any loss arising from your failure to safeguard your credentials.

5. License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Services for your personal, non-commercial purposes. We reserve all rights not expressly granted to you.

6. Acceptable Use

You agree that you will not, and will not attempt to:

use the Services for any unlawful, fraudulent, or unauthorized purpose;
violate any applicable law or regulation or the rights of any third party;
reverse engineer, decompile, or attempt to extract the source code of the Services, except as permitted by law;
interfere with, disrupt, or impose an unreasonable load on the Services or related infrastructure;
attempt to gain unauthorized access to any account, system, or data;
use the Services to transmit malware or other harmful code; or
use automated means to access the Services in a manner that violates these Terms.

7. Your Content and Data

You retain all ownership rights in the Content and Financial Data you submit. You grant us a limited license to host, process, and display your Content solely to operate and provide the Services to you, including processing Content through AI Features and Service Providers as described in our Privacy Policy. You are solely responsible for the accuracy and legality of your Content.

8. Financial Disclaimer

Kartenpae is a personal money-tracking and analytics tool. It is not a bank, financial institution, broker, tax preparer, or licensed financial, investment, accounting, or legal advisor, and nothing in the Services constitutes financial, investment, tax, or legal advice. Any figures, budgets, projections, or insights generated by the Services (including by AI Features) are estimates provided for informational purposes only and may be incomplete or inaccurate. You are solely responsible for your financial decisions and should consult a qualified professional where appropriate.

9. AI Features

AI Features analyze the text, images, or voice you submit to produce automated categorizations and summaries. AI output may contain errors and should be reviewed and corrected by you. We do not warrant the accuracy, completeness, or suitability of any AI output, and your reliance on it is at your own risk.

10. Third-Party Services

The Services integrate with third-party providers, including authentication, notification, AI processing, LINE messaging, and hosting providers. We do not control and are not responsible for third-party services, which may experience limitations, interruptions, or changes. Your use of such services may be subject to their respective terms and policies.

11. Intellectual Property

The Services, including all software, design, text, graphics, logos, the "Kartenpae" name and mascot, and other materials (excluding your Content), are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited license granted above, nothing in these Terms transfers any intellectual-property rights to you.

12. Fees and Optional Paid Features

Core features of the Services are currently provided free of charge. We may introduce optional paid features or subscriptions in the future; if we do, applicable pricing and terms will be presented to you before you incur any charge.

13. Termination

You may stop using the Services and request deletion of your Account at any time via the "Delete Account" page, the in-app option, or by contacting us. We may suspend or terminate your access to the Services, with or without notice, if you violate these Terms or if we reasonably believe such action is necessary to protect the Services or other users. Upon termination, the licenses granted to you will cease, and provisions that by their nature should survive will survive.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR PRESERVED.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARTENPAE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR ONE THOUSAND THAI BAHT (THB 1,000).

16. Indemnification

You agree to indemnify and hold harmless Kartenpae and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your Content, your use of the Services, or your violation of these Terms or any applicable law.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts of Thailand, except where applicable law grants you the right to bring proceedings in your local courts.

18. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.

19. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
